Federal ADA website accessibility lawsuits continue rising sharply. Through mid-2025, over 2,000 federal cases have been filed — roughly a 37 % increase from 2024 — and government entities (cities/counties) now make up a growing percentage of defendants, especially with accessibility deadlines looming.

ADA QuickScan

National reports show thousands of ADA-based digital accessibility lawsuits already filed in recent years, with high-volume states like New York, Florida, and California especially active, though filings occur across all 50 states.

Localized Lawsuits: Florida Example

In Gainesville, FL, dozens of local businesses have been sued (totaling 49+) by a single plaintiff alleging their websites don’t work with assistive technology like screen-to-text devices.

What This Means for Businesses

Lawsuits are not only continuing but diversifying

Federal suits, state law claims, and DOJ enforcement all add layers of risk.

Serial plaintiffs and law firms are a major factor in volume.

Compliance deadlines are driving urgency

Government sites have specific WCAG compliance deadlines (e.g., April 2026 for many entities), and plaintiffs are leveraging this.

Automated widgets ≠ legal safety

FTC scrutiny of accessibility tools highlights that simply adding a widget may not satisfy ADA standards or stop suits.

The first violation is $75,000 plus legal expenses.

Call Tonight

This evening, I got a call from a Build Your Firm website client in northern Florida who heard about this through the grape vine (probably a client). He's been a website client for 15-20 years and wanted to make sure he was covered. Heck, he had the original website from 15-20 years ago. No, he's not covered. For an extra $250, he is now protected and we will upgrade his ole website in the process for nothing extra.

Please call your website provider to ensure you are covered.

BYF provides a ADA compliant website for $250 extra.  As Nike would say, just do it!!
